Sorrow and Accusations: Guyger Trial Day 2

It was heartbreaking to watch Officer Mike Lee's bodycam video today.  I thought of my little brother, who I love so much.  Lying there, lifeless.  His Driver License that they held up, now useless.  Those officers didn't know him the day before, nor did they care about him.  Now, they exert themselves, passionately trying to revive this poor young man.  It breaks my heart.

But, they have no case.  Again today, we see the prosecution try to vilify Guyger, which won't get her convicted. 
 
Today, we learned that 23% of every person who lives in that complex did the EXACT same thing Amber Guyger did: Went to the wrong apartment, put key in and tried to open the door.  The only difference, this time, because of faulty metal strike plates that bow only when it's humid, caused the door to not lock/stay ajar. Only 1 person out of the 23% that did this would come upon the door open/ajar.  That's Ms. Guyger.  Tragic.

Dallas Police Association came under fire for their President Mike Matta showing up and ordering the officer to turn off the recording device in the squad and let Guyger out of the squad, where he could hug her and give her advice.  I have no problem with that, but I can see how others do.  However, it's irrelevant to the charge and that's why the Judge kept that out of the jury's purview.  Smart move, as it would have had the case thrown out on appeal.

Folks want a pound of flesh in this case.  The simple fact of the matter is, she won't be found guilty of Murder because of "Mistake of Fact".  It's reasonable for her to have mistook this for her apartment.  That's Texas law.  That means no charge will stick, not any lesser charge, like Manslaughter, etc.  You'll have to make up a new law to get your pound of flesh.

No, SOP (standard operating proceedure) is not relevant here, as she was "in her home" and off duty.  No "duty to retreat" here.  No, she shouldn't have "used a taser" because when you're defending your "home" in Texas, deadly force is A-OK.  No, she did not shoot Botham as he "crouched behind the kitchen wall", she shot him at about 13 feet as he kept coming towards her.

Marijuana was very much there and being used.  Air Pods have now entered the equation: He may have had music on, so that he couldn't hear much of anything.  

And "Weed Man", as I call him..Bothams neighbor who bonded with Botham over their apartments reeking of weed, said he heard them yelling at each other for moments before shouts, but that he didn't her her give commands, like "stop" or "show me your hands".  Well, of course you couldn't make out what she was saying...in your own words "They were both talking at the same time, so you couldn't understand what they were saying".  DUH.  Lay off the weed, Weed Man.

A bullet to the heart most likely flat lined Botham immediately-unfortunately.  The idea that Guyger cared nothing for his well being is a farce, and even if true, that's not a crime. 


Nothing here, but to attack her character.
